TripGuard – Terms of Use Last Updated: 26th March, 2026
Welcome to TripGuard.
These Terms of Use (“Terms”) govern your access to and use of the TripGuard mobile application (the “App”).
TripGuard is owned and operated by ThirdTap Technologies Limited, a company incorporated under the laws of the Republic of Ghana.
TripGuard exists to promote safer roads and transportation experiences through responsible, community-driven safety reporting.
By downloading, accessing, or using the App, you agree to be legally bound by these Terms. If you do not agree to these Terms, you must not use the App.
If you are under the age of 13, you may only use the App under the supervision of a parent or legal guardian.
By using the App, you represent and warrant that you meet these eligibility requirements.
Maintaining the confidentiality of login credentials
Providing accurate and truthful information
Updating personal details when necessary
ThirdTap Technologies Limited reserves the right to suspend or terminate accounts that:
Violate these Terms
Engage in misuse of reporting tools
Submit malicious or harmful content
Present legal, safety, or reputational risks to the platform
Users agree not to:
Use TripGuard for unlawful, fraudulent, or harmful purposes
Submit false, misleading, exaggerated, altered, or malicious reports
Harass, threaten, impersonate, or intimidate others
Attempt to manipulate TripGuard’s reporting system
Interfere with the security, functionality, or stability of the App
All reports must be submitted truthfully, responsibly, and in good faith.
Misuse of the platform may result in account suspension or termination.
4.1 Good Faith Protection
TripGuard encourages users to submit honest, evidence-based reports about safety incidents. Reports submitted in good faith—based on the reporting user’s reasonable belief that the information is true and accurate—shall not subject the reporting user to liability toward TripGuard.
4.2 Warning of Personal Liability
Users are expressly warned that submitting false, defamatory, or malicious reports may result in:
Civil liability, including claims for defamation, damages, and legal costs
Criminal liability under the laws of the Republic of Ghana
Account suspension or permanent termination
Users are strongly advised to:
Ensure reports are truthful and supported by evidence before submission
Keep records of evidence (photos, videos, receipts, communications) for their own protection
Seek legal advice if uncertain about the truthfulness or legality of a proposed report
4.3 No Legal Advice
TripGuard does not provide legal advice. Nothing in these Terms constitutes a recommendation or opinion regarding the legal viability of any report.
TripGuard is a community safety reporting platform.
TripGuard:
Does not independently verify every report
Does not investigate incidents
Does not determine guilt or wrongdoing
Does not guarantee the accuracy, completeness, or reliability of user-submitted content
All reports displayed on the App are user-generated submissions.
TripGuard acts solely as a technology platform that enables users to submit and view safety-related reports.
TripGuard does not adopt, endorse, validate, or guarantee the truthfulness of user submissions.
Users must exercise personal judgment when interpreting information available on the platform.
TripGuard may monitor and review content to maintain platform integrity.
TripGuard may remove, restrict visibility of, or archive content that falls into the following categories:
Spam, duplicate, or irrelevant submissions
Harassment, threats, or intimidation
Hate speech or discriminatory content
Sexually explicit material
Content that violates applicable law
Content that creates legal or reputational risk to the platform
6.2 No Verification Through Moderation
Moderation decisions are made solely to remove prohibited content and do not constitute verification, endorsement, or validation of any report that remains visible on the platform.
The presence of a report on TripGuard does not mean TripGuard has confirmed its truthfulness. The absence of a report does not mean TripGuard has determined it to be false.
6.3 Moderation Discretion
TripGuard reserves sole discretion in determining whether content violates these Terms. Users may not appeal moderation decisions except as provided in Section 8 (Content Disputes).
7.1 Dispute Process
If any individual believes that content published on TripGuard is:
inaccurate
defamatory
misleading
harmful
they may submit a content dispute or removal request to TripGuard at: tripguardapp@gmail.com
7.2 TripGuard’s Role
TripGuard does not adjudicate truth disputes between users. Upon receiving a dispute notice, TripGuard may:
Review the content to determine whether it violates these Terms (e.g., spam, harassment, illegal content)
Remove content that clearly violates these Terms
Take no action if the content does not violate these Terms
7.3 Rebuttal Mechanism
If TripGuard determines that content does not violate these Terms but a dispute regarding truthfulness remains, the affected individual may submit a rebuttal statement.
Rebuttal statements shall:
Be displayed alongside the original report
Be limited to [500] words
Not contain prohibited content (harassment, threats, etc.)
Be published without endorsement or verification by TripGuard
7.4 No Admission of Liability
TripGuard’s removal of content or acceptance of rebuttals shall not be construed as an admission that any report was false, defamatory, or unlawful.
By creating an account and using the App, users acknowledge and consent to the following features.
8.1 Safety Lookups
Verified users may search identifiers connected to incident reports, including:
Vehicle registration numbers
Phone numbers
Other identifiers voluntarily submitted in relation to reported incidents
These lookups exist solely to promote safety awareness and informed decision-making.
8.2 Limited Data Display
TripGuard:
Does not display personal profiles publicly
Does not reveal private identity information beyond what users voluntarily submit in reports
Does not alter, rewrite, or modify user-submitted report text
Displayed content reflects the exact submission of the reporting user.
8.3 Data Subject Rights
Individuals whose identifiers appear in reports may request:
Correction of factual inaccuracies (where evidence is provided)
Removal of content that violates these Terms
Information about what data TripGuard holds relating to them

TripGuard reserves the right to deny requests that are manifestly unfounded, excessive, or where retention is required for legal or safety purposes.
TripGuard is an independent platform.
TripGuard is not affiliated with, endorsed by, or partnered with any ride-hailing or transport companies, including but not limited to:
Uber
Bolt
Yango
Shaxi
Mijo
Taxi unions or transport operators
TripGuard does not access, scrape, extract, or integrate with private databases of ride-hailing platforms.
TripGuard operates independently as a public safety reporting tool.
All reports, comments, and submitted materials constitute User-Generated Content (“UGC”).
Users are solely and personally responsible for:
The accuracy of their submissions
The legality of their statements
All consequences arising from false, defamatory, or malicious content
TripGuard does not verify or guarantee the accuracy of reports submitted by users.
Users who submit false, defamatory, malicious, or harmful reports may be held personally legally liable under the laws of the Republic of Ghana, including claims for defamation, damages, and legal costs.
TripGuard reserves the right to:
Remove content that violates these Terms
Suspend or terminate accounts
Restrict visibility of reports
Cooperate with law enforcement authorities when legally required
TripGuard processes user data in accordance with applicable laws of the Republic of Ghana, including the Data Protection Act, 2012 (Act 843) .
11.2 Registration
ThirdTap Technologies Limited is registered with the Data Protection Commission of Ghana.
11.3 Separate Privacy Policy
The collection, use, and protection of personal data are governed by TripGuard’s Privacy Policy, which forms part of these Terms.
Users acknowledge having read and understood the Privacy Policy.
11.4 Lawful Processing
TripGuard processes personal data on the following lawful bases:
Performance of a contract (providing the App’s functionality)
Legitimate interests (promoting public safety and preventing harm)
Consent (where users voluntarily submit reports)
Compliance with legal obligations
11.5 Data Retention
TripGuard retains user data and reports only as long as necessary to fulfill the purposes described in these Terms and the Privacy Policy, or as required by law.
TripGuard may periodically remove, archive, or limit the visibility of older reports to ensure that the platform reflects current and relevant safety information.
Archived reports may not remain publicly visible indefinitely.
The retention period for reports is generally [12 months] unless:
The report is associated with an ongoing dispute
Retention is required for legal or safety purposes
The reporting user requests earlier removal
You agree to indemnify and hold harmless ThirdTap Technologies Limited, its directors, officers, employees, and affiliates from any claims, damages, liabilities, losses, legal fees, or expenses arising from:
Reports you submit
Your misuse of the App
Violations of these Terms
Legal claims brought by third parties due to your content
This indemnification obligation survives termination of your account.
The App is provided “as is” and “as available.”
TripGuard makes no warranties regarding:
The accuracy, completeness, or reliability of user-generated reports
Uninterrupted availability of the platform
Absence of errors or harmful components
Fitness for a particular purpose
Users understand that:
Community reports are not official findings or determinations
TripGuard does not replace law enforcement, regulatory authorities, or professional judgment
Users must exercise independent judgment when relying on information
To the fullest extent permitted under the laws of the Republic of Ghana, ThirdTap Technologies Limited shall not be liable for:
Decisions made based on user-submitted reports
False, defamatory, or malicious reports submitted by users
Disputes between drivers and riders or other users
Reputational or economic harm arising from user-generated content
Loss of income, opportunities, or livelihood
Technical failures, service outages, or data loss
If liability is established notwithstanding this limitation, it shall not exceed:
The amount paid by the user to access the App in the 12 months preceding the claim, or
GHS 100 (or equivalent), whichever is greater
This limitation of liability reflects the allocation of risk agreed between the parties and forms an essential basis of these Terms.
TripGuard maintains defamation and cyber liability insurance to protect the platform and its users against certain risks associated with user-generated content.
Users are advised that this insurance does not extend to cover:
Liability arising from a user’s own false or malicious reports
Legal defense costs incurred by users in defamation claims
Users remain personally responsible for their own legal exposure.
TripGuard may suspend or permanently terminate accounts that:
Violate these Terms
Submit false, defamatory, or malicious reports
Attempt to manipulate the reporting system
Create legal, safety, or reputational risk for the platform
Upon termination:
Access to the App is revoked
Reports submitted by the user may be removed or archived
Data will be retained only as required by law
Users may terminate their own accounts at any time by contacting TripGuard.
18.1 Governing Law
hThese Terms are governed exclusively by the laws of the Republic of Ghana.
18.2 Dispute Resolution
Any disputes arising from or relating to these Terms or the use of TripGuard shall first be referred to mediation at the Alternative Dispute Resolution Centre of Ghana (or equivalent recognized body) before either party may commence litigation.
If mediation does not resolve the dispute within 30 days, either party may refer the matter to the courts of Ghana.
18.3 Jurisdiction
The courts of the Republic of Ghana shall have exclusive jurisdiction over any disputes not resolved through mediation.
TripGuard may revise these Terms at any time.
Material changes may be notified to users through:
In-app notification
Email to registered users
A prominent notice within the App
Continued use of the App after changes are published constitutes acceptance of the updated Terms.
Users are encouraged to review these Terms periodically.
